Probate and estate sales
- If you’re an executor, the Monmouth County Surrogate issues the Letters Testamentary that give you authority to sell. If there was no will, the court appoints an administrator, who receives Letters of Administration.
- Real estate may need New Jersey inheritance tax waivers before it can be transferred, depending on who inherits. Spouses, children, and grandchildren are generally exempt from the tax, but the paperwork still has to be done. Your attorney and the title company will handle it; we coordinate timing.
Divorce sales
- Divorces are heard in the Family Part of the Superior Court. If the court or a settlement agreement says the house must be sold, a cash sale gives both sides a firm number and a firm date, without months of showings.
- Both owners on the deed will need to sign. We communicate with both sides (and their attorneys) as needed.
